Re: Material Safety Data Sheets (MSDS)

We appreciate the opportunity to respond to your inquiry regarding Material Safety Data sheets (MSDS). Atlas Roofing Corporation shingle products and rolled roofing products are considered "articles". As defined by the Occupational Safety and Health Administration's (OSHA) Hazard Communication Standard, "articles" are exempt from the MSDS requirement as they are not considered to be health or physical hazards.
The Code of Federal Regulations, Title 29, Section 1910.1200 (amended) states that articles are exempt from the requirement of publishing MSDS:
"Article means a manufactured item, other than a fluid or particle:
(i) Which is formed to a specific shape or design during manufacture; (ii) which has end use function(s) dependent in whole or in part upon it's shape or design during end use; and (iii) which under normal conditions of use does not release more than very small quantities, e.g., minute or trace amounts, of a hazardous chemical and does not pose a physical hazard or health risk to employees."
Atlas Roofing Corporation products meeting the Article definition and do not require MSDS sheets include all shingles products as well as Saturated Felts, Underlayments, and Mineral Surface Roll Roofing.
